Terms of Sale of Online Masterclasses and In-Person Workshops
Background
(A) These Terms of Sale together with the attachment below and any and all other documents referred to in these Terms of Sale set out the terms and conditions on which you, whether for yourself or your child, may purchase an educational workshop or masterclass as sold by Us to Consumers through this website, https://gobeyondbooks.com/ (“Our Site”).
(B) Masterclasses purchased from or via Our Site use a cloud-based web conferencing platform as set out in the attachment below only for ease of reference but they will have the same effect as if set out in these Terms of Sale.
(C) Please read these Terms of Sale and the attachment below carefully and ensure that You understand them before making a purchase. If You have any query about anything in these Terms of Sale or the attachment, please contact Us to discuss the same.
(D) All of the information that We give to You will be part of the terms of Our Contract with You as a Consumer whether it is information that We are required by law to give to You before You make a purchase, or voluntarily give to You and You rely on it when deciding to purchase Our Services.
(E) These Terms of Sale, as well as any and all Contracts, are in the English language only.
(F) These Terms of Sale apply to the sale of all Services from Our Site where You are a Consumer.
1. Definitions and Interpretation
In these Terms of Sale, unless the context otherwise requires, the following expressions have the following meanings:
“Background Items” means background and other information about topics relevant to diet, health, fitness, wellness and/or nutrition programmes that We provide to You, downloadable or viewable as text or graphics.
“Consumer” means an individual customer who has asked Us to provide Our Services to the Student comprising Paid Content for their personal use and for purposes wholly or mainly outside the purposes of any business, trade, craft or profession.
“Contract” means a contract for the purchase of Our Services, as explained in Clause 9.
“Services” means collectively any Workshop or Masterclass and any other work that We carry out for You under these Terms and Conditions.
“Paid Content” means any content (including text, graphics, images, audio, and video) comprising any session, Background Items or other materials or information which We offer through Our Site and make available by means of two-way synchronous livestream audio and/or video technology, asynchronous livestream content, or downloadable/viewable materials.
“Workshop” means a course of tutoring carried out in person at a suitable location sourced by Us.
“Masterclass” means a one-hour tutoring session carried out virtually by means of cloud-based web conferencing. Masterclasses are provided for up to six children at any one time.
“Student” means any person, whether under 18 years old or not, who We are engaged to provide a Workshop or Masterclass to.
“Purchase Confirmation” means Our acceptance and confirmation of Your purchase from Us.
“You / Your” means the person purchasing Our Services.
“We / Us / Our” means Phoebe James Education Ltd trading as Beyond Books.
2. Information About Us
Our Site, https://gobeyondbooks.com/, is owned and operated by Phoebe James Education Ltd trading as Beyond Books, a company registered in England under company number 13418136 whose registered office address is Bleak House, Bowley Lane, Hereford, Herefordshire, HR1 3LG.

4. Consumers Only and Age Restrictions
4.1 These Terms of Sale apply only to Consumer purchases from Our Site. If You are a business and wish to instruct Us please contact Us prior to making any purchases.
4.2 Services must only be purchased by individuals over the age of 18. Where the Student is under 18, the purchase must be made by a parent or guardian who enters into a legally binding contract on behalf of the Student.
4.3 Where the Student is under 18, the Student must be accompanied by a parent, guardian, or another responsible adult who must be present in the building during the Workshop or Masterclass.
5. Business Customers
These Terms of Sale do not apply to customers purchasing the Services in the course of any business trade, craft, or profession.
6. Our Services
You will be required to make payment via Our Site prior to any Services being undertaken and, where applicable, schedule a Workshop date and time.
You must provide learning needs and details of any relevant physical, medical, mental health or other requirements at least 24 hours prior to the Workshop or Masterclass.
We reserve the right to refuse to provide Services where there is a determinable risk to the Student.
If a Student arrives more than 10 minutes late or is not ready to begin, the session may be forfeited without refund.
7. Cancelling and Rescheduling
Where a Workshop or Masterclass is cancelled with less than 48 hours’ notice, payment will be forfeited.
Workshops may be rescheduled with at least 48 hours’ notice. Masterclasses cannot be rescheduled.
Recording of any Services is not permitted without Our written consent and may incur an additional fee.
8. Pricing and Availability
Pricing is confirmed in the Purchase Confirmation. Minor changes may be made to Services to reflect legal or regulatory requirements.
9. Orders and Contract Formation
A binding contract is formed only once We issue a Purchase Confirmation email.
10. Payment
Full payment is required at the time of booking. All payments must be made via Shopify payment methods.
11. Licence
Upon purchase, the Student is granted a limited, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes only.
12. Cooling-Off Period and Cancellation
Consumers have a 14-day cooling-off period unless the Services are accessed earlier, after which refunds are not available.
13. Other Rights to End the Contract
You may end the Contract where We are unable to deliver Services for more than 90 days or where We are in breach.
14. Our Liability
We are responsible for foreseeable loss caused by Our breach or negligence. Nothing limits Your statutory consumer rights.
15. Complaints and Feedback
Feedback and complaints may be submitted using the contact details in Clause 3.
16. Data Protection
Personal data will be handled in accordance with Our Privacy & Cookies Policy available at https://gobeyondbooks.com/policies/privacy-policy.
17. Other Important Terms
We may revise these Terms from time to time in response to changes in law or regulation.
18. Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Consumers may bring proceedings in their country of residence.
Attachment – Use of Zoom
Masterclasses are delivered using Zoom. We are not responsible for the Zoom platform or any third-party technology used to access the Services.
You are responsible for ensuring you have suitable equipment, internet access, and a suitable environment to participate.
